La ley jurídica preserva sorprendentemente un contenido de ínsita verdad y solidez, caracteres de los que aún la ley científica, siempre hipotética y provisoria, ya no presume. En el presente artículo se pretende esbozar un camino hacia la explicación de este anacronismo, a través de las modalidades asumidas por la ley para hacer regir las regularidades del mundo. La ley es una estrategia para controlar el espacio y eludir el tiempo. Cada época ha tenido sus formas de llevar a cabo (...) ese control / elusión, desde una certeza original que le sirva de ubicación y referencia. Los valores de la ley están relacionados con el residuo de cada una de las certezas originales sobre las que se instauró históricamente. A fin de obtener dichos fines, necesita tanto de la sedimentación de las sucesivas capas de venerabilidad, como del ahogo de la memoria y del tiempo y de la historia que las han concebido y desarrollado. La evaluación es un aspecto que predomina en la educación, pero que necesita ser repensada. Este artículo reflexiona sobre la noción de evaluación en la sociedad actual y propone una alternativa a lo que ella podría y debería ser. Como resultado de un estudio crítico del papel de la evaluación en la educación actual, decidimos llevar a cabo un análisis hermenéutico de la influencia del concepto original de evaluación en la posibilidad de alejarse de la tributación del sujeto y su (...) actual pornificación. A través de una discusión sobre el papel de la evaluación en la sociedad contemporánea y su verdadera naturaleza, los autores proponen un cambio de mirada sobre la evaluación como un mero complemento al plan de estudios a otra que considere cómo una filosofía de la evaluación podría transformar profundamente la educación y la sociedad. This article establishes some important similarities between Husserl’sthoughts about the nature of science and the semantic view of scientific theories. This last conception affirms that empirical theories do not describe the world as it is, but that they idealize and represent it using structural models. In this sense and prima facie, the semantic conception coincides with Husserl’s point of view regarding the life-world and the world of science.

Se defiende que el concepto de cuerpo individual en el interior de dicha cosmología se puede construir como una ficción del espíritu. This open access book discusses individual, collective, and institutional responsibilities with regard to vaccination from the perspective of philosophy and public health ethics. It addresses the issue of what it means for a collective to be morally responsible for the realisation of herd immunity and what the implications of collective responsibility are for individual and institutional responsibilities. The first chapter introduces some key concepts in the vaccination debate, such as ‘herd immunity’, ‘public goods’, and ‘vaccine refusal’; and explains why failure (...) to vaccinate raises certain ethical issues. The second chapter analyses, from a philosophical perspective, the relationship between individual, collective, and institutional responsibilities with regard to the realisation of herd immunity. The third chapter is about the principle of least restrictive alternative in public health ethics and its implications for vaccination policies. Finally, the fourth chapter presents an ethical argument for unqualified compulsory vaccination, i.e. for compulsory vaccination that does not allow for any conscientious objection. The book will appeal to philosophers interested in public health ethics and the general public interested in the philosophical underpinning of different arguments about our moral obligations with regard to vaccination. What is depiction? This is a venerable question that has received many different answers throughout the whole history of philosophy, especially in contemporary times. A Syncretistic Theory of Depiction elaborates a new account on this matter by providing a theory of depiction that tries to combine the merits of the previous theories while dropping their defects. It is argued that a picture is a representation in a pictorial or figurative mode, and its 'figurativity' is given by a special perception, perceiving-in, (...) whose nature is reconceived. Such a perception inter alia grasps some properties which the picture's vehicle has in common with what is perceived in it; by so doing, that perception provides the picture with a figurative content. In contrast, the picture's representational value, its subject or its pictorial content, is given by a conventionally or causally based selection out of that figurative content. (shrink)

Beginning from some passages by Vācaspati Miśra and Bhāskararāya Makhin discussing the relationship between a crown and the gold of which it is made, this paper investigates the complex underlying connections among difference, non-difference, coreferentiality, and qualification qua relations. Methodologically, philological care is paired with formal logical analysis on the basis of ‘Navya-Nyāya Formal Language’ premises and an axiomatic set theory-based approach. Some people have stressed that there is a close analogy between meaning experiences, i.e., experiences as of understanding concerning linguistic expressions, and seeing-in experiences, i.e., pictorial experiences of discerning a certain item – what a certain picture presents, viz. the picture’s subject – in another item – the picture’s vehicle, the picture’s physical basis. Both can be seen as fusion experiences, in the minimal sense that they are experiential wholes made up of different aspects. Actually, two important similarities between such (...) experiences may lead one to think that they are experiences of the same type. In this paper, however, I will try to show that notwithstanding such similarities, these experiences are typologically different. For there are two dissimilarities between such experiences that are more relevant on this typological concern than their similarities. Indeed, unlike meaning experiences, seeing-in experiences are first of all recognitional experiences of a sort that makes them perceptual experiences as well. Moreover, again unlike meaning experiences, seeing-in experiences are fusion experiences in the substantial sense that the experiential whole is more than the sum of its experiential parts taken in isolation, for when such parts figure in that whole, they interact with each other. In a nutshell, unlike meaning experiences, seeing-in experiences are proper fusion experiences. (shrink)

I argue that there are significant moral reasons in addition to harm prevention for making vaccination against certain common infectious diseases compulsory. My argument is based on an analogy between vaccine refusal and tax evasion. First, I discuss some of the arguments for compulsory vaccination that are based on considerations of the risk of harm that the non‐vaccinated would pose on others; I will suggest that the strength of such arguments is contingent upon circumstances and that in order to provide (...) the strongest defence possible of compulsory vaccination, such arguments need to be supplemented by additional arguments. I will then offer my additional argument for compulsory vaccination: I will argue that in both cases of vaccine refusal and of tax evasion individuals fail to make their fair contribution to important social and public goods, regardless of whether each individual contribution ‘makes a difference’. While fairness considerations have sometimes been used to support a moral duty to vaccinate, they have not been appealed to in order to argue for a legal duty to vaccinate. I will suggest that this is due, among other things, to a misapplication of the principle of the least restrictive alternative in public health. In this paper, I want to deal with the problem of how to find an adequate context of interpretation for indexical sentences that enables one to account for the intuitive truth-conditional content which some apparently puzzling indexical sentences like “I am not here now” as well as other such sentences contextually have. In this respect, I will pursue a fictionalist line. This line allows for shifts in interpretation contexts and urges that such shifts are governed by pretense, which has to (...) be understood in terms of socially shared make-believe games. By appealing to pretense so conceived, I will show that the fictionalist perspective is halfway between an intentionalist perspective, according to which the above indexical sentences have to be interpreted in a shifted intended context, (this perspective is primarily defined by Predelli 1998, Analysis 58, 107; Mind and Language 13, 400) and a conventionalist perspective, according to which indexical reference shifts in accordance with a conventional setting. (For this perspective, cf. Corazza et al. 2002, Philosophical Studies 107, See also Corazza 2004, Reflecting the Mind: Indexicality and Quasi-Indexicality, Oxford University Press). Finally, I will claim that the fictionalist analysis of cases of non-ordinary uses of indexicals like “here” and “now” can be retained in face of a new alternative analysis of those cases in terms of an ‘unbound anaphora’ – theory (cf. In this essay, I defend a Wollheimian account of a twofold picture perception. While I agree with Wollheim’s objectors that a picture involves three layers that qualify a picture in its complexity -- its vehicle, what is seen in it, and its subject --, I argue that the third layer does not involve perception, even indirectly: what is seen in a picture constrains its subject to be a subject of a certain kind, yet it does not force the latter to (...) be pictorially perceived, not even indirectly. So, even if a picture is three-layered, pictorial experience remains a twofold experience, as Wollheim claimed. Neither the proponents of threefoldness nor Wollheim himself, however, have convincingly explained how the experience really is a perceptual experience. My Wollheimian account thus aims to reconceive the pictorial experience in properly perceptual terms. (shrink)

We address the issue of whether, why and under what conditions, quarantine and isolation are morally justified, with a particular focus on measures implemented in the developing world. We argue that the benefits of quarantine and isolation justify some level of coercion or compulsion by the state, but that the state should be able to provide the strongest justification possible for implementing such measures. While a constrained form of consequentialism might provide a justification for such public health interventions, we argue (...) that a stronger justification is provided by a principle of State Enforced Easy Rescue: a state may permissibly compel individuals to engage in activities that entail a small cost to them but a large benefit to others, because individuals have a moral duty of easy rescue to engage in those activities. The principle of State Enforced Easy Rescue gives rise to an Obligation Enforcement Requirement: the state should create the conditions such that submitting to coercive or compulsive measures becomes a fundamental moral duty of individuals, i.e. a duty of easy rescue. When the state can create such conditions, it has the strongest justification possible for implementing coercive or compulsive measures, because individuals have a moral duty to temporarily relinquish the rights that such measures would infringe. Our argument has significant implications for how public health emergencies in the developing world should be tackled. Where isolation and quarantine measures are necessary, states or the international community have a moral obligation to provide certain benefits to those quarantined or isolated. (shrink)

The present paper is a continuation of a previous one by the same title, the content of which faced the issue concerning the relations of coreference and qualification in compliance with the Navya-Nyāya theoretical framework, although prompted by the Advaita-Vedānta enquiry regarding non-difference. In a complementary manner, by means of a formal analysis of equivalence, equality, and identity, this section closes the loop by assessing the extent to which non-difference, the main issue here, cannot be reduced to any of the (...) former. The following sections of this study will focus on the assessment of the eventual possibility of causation and transformation in non-difference. (shrink)

We argue that, from the point of view public health ethics, vaccination is significantly analogous to seat belt use in motor vehicles and that coercive vaccination policies are ethically justified for the same reasons why coercive seat belt laws are ethically justified. We start by taking seriously the small risk of vaccines’ side effects and the fact that such risks might need to be coercively imposed on individuals. If millions of individuals are vaccinated, even a very small risk of serious (...) side effects implies that, statistically, at some point side effects will occur. Imposing such risks raises issues about individual freedom to decide what risks to take on oneself or on one’s children and about attribution of responsibility in case of adverse side effects. Seat belt requirements raise many of the same ethical issues as vaccination requirements, and seat belt laws initially encountered some opposition from the public that is very similar to some of the current opposition to vaccine mandates. The analogy suggests that the risks of vaccines do not constitute strong enough reasons against coercive vaccination policies and that the same reasons that justify compulsory seat belt use—a measure now widely accepted and endorsed—also justify coercive vaccination policies. Wittgenstein defiende que los problemas filosóficos son ilegítimos. Sin embargo, no resulta del todo claro qué se entiende en general por problema filosófico, cuál es, pues, su naturaleza. El presente artículo intenta elucidar la observación de Wittgenstein que sostiene que la forma de un problema filosófico se puede presentar con la expresión “Yo no sé salir del atolladero” (IF § 123). En el artículo se elige, a manera de ejemplo, el escándalo kantiano, que demanda que demostremos con el uso de (...) la razón que la proposición “hay objetos físicos” es verdadera. Sin renunciar al ejemplo, se explora en qué sentido la expresión de Wittgenstein caracteriza en buena medida la naturaleza misma de la dificultad filosófica. En el ejercicio se atienden recomendaciones formales del Tractatus, terapias desplegadas en Sobre la Certeza y el recurso de distinguir entre sentido primario y sentido secundario de una expresión insinuado en las Investigaciones Filosóficas. A implementação de tecnologias móveis de informação e comunicação no suporte à Saúde Mental tem atraído a atenção das autoridades. Com a ascensão das Inteligências Artificiais, esse movimento pode ser impulsionado de maneira exponencial. Nesse cenário, esta revisão tem como objetivos verificar a aplicabilidade das Inteligências Artificiais (IAs) na Saúde Mental e analisar os aspectos que favorecem a relação entre IAs e usuários. Para tanto, realizou-se uma revisão sistemática nas bases de dados PubMed e Biblioteca Virtual em Saúde, no período (...) de 25 de maio a 23 de junho de 2023. Selecionamos os 100 primeiros artigos mais relevantes com as palavras-chave: “Inteligência Artificial”, “Saúde Mental”, “Chatbots”, “Psicoterapia”, “Psicologia” e suas equivalentes em inglês. Os critérios de inclusão foram: acesso aberto, publicação a partir de 2018, em português ou inglês e menção à atuação de IAs no âmbito da Saúde Mental. Para reduzir o risco de viés, excluímos os estudos que não mensuraram o impacto das intervenções por meio de métodos experimentais ou quase-experimentais. Para a síntese dos dados, delimitaram-se alguns pontos específicos de análise, como “Resultado da intervenção”, “Aspectos que favorecem a relação”, entre outros. Atenderam aos critérios de inclusão 24 estudos, dos quais 17 apresentaram resultados positivos em suas intervenções. O uso de IAs na Saúde Mental possui grande potencial de expansão e os resultados obtidos neste trabalho podem guiar a implementação dessas práticas e futuras pesquisas na área. (shrink)

La noción de verdad ha sido siempre el tesoro de la filosofía, su objeto de estudio y debate durante siglos, sin embargo, en la actualidad hay numerosas perspectivas que ofrecen respuestas innovadoras a la relación entre verdad, conocimiento y realidad, pero ninguna de ellas tiene una claridad abrumadora como la que nos ofrece la filosofía de Alain Badiou. Es que no se queda en poner su postura frente al debate, sino que resuelve lo que a las otras perspectivas les faltaba. (...) El tema abordado en este artículo es relevante al menos por tres razones: en primer lugar, porque al tocar la relación entre verdad, conocimiento y realidad en Badiou se vuelve sobre un lugar clásico dentro de la tradición filosófica, en segundo lugar, porque, al plantear el problema, no solo se queda en el campo de la filosofía sino que ronda el debate actual en múltiples campos los que denomina procedimientos genéricos de verdades, en tercer lugar, porque se intenta explorar las relaciones entre verdad y conocimiento en la filosofía de Badiou, algo no muy frecuente en los estudios badiousianos. Husserl places “around 1898” the introduction of the notion of ‘ phenomenon’ in his philosophy. If one of the tasks of the history of philosophy is to circumscribe the problems which originated the creation of a new concept in some doctrine, the purpose of this paper is to investigate what difficulties had roused the invention of the idea of ‘phenomenon” in the husserlian philosophy.

Husserlian phenomenology has been interpreted as a method of knowledge that can be applied to different domains and which would compete with other methods to give us a better understanding of the “real”, the “man” or “society”. Moreover, “phenomenological idealism” has been presented as an “ontological” or “metaphysical” thesis, in the pre-critical sense of the term. The goal of this study is to suggest that these two theses imply the tacit identification of the natural attitude and the phenomenological one, avoiding (...) the difference between the objects to which these attitudes relate. Therefore, a phenomenological truth does not anticipate any opinion about the “world”. (shrink)

To the extent that antibiotic resistance (ABR) is accelerated by antibiotic consumption and that it represents a serious public health emergency, it is imperative to drastically reduce antibiotic consumption, particularly in high‐income countries. I present the problem of ABR as an instance of the collective action problem known as ‘tragedy of the commons’. I propose that there is a strong ethical justification for taxing certain uses of antibiotics, namely when antibiotics are required to treat minor and self‐limiting infections, such as (...) respiratory tract infections, in otherwise healthy individuals. Taxation would allow a reduction in consumption (given certain behavioural economics assumptions) and/or ensure that individuals internalize or compensate for their contribution to the erosion of the common good of antibiotic effectiveness. I suggest that revenue from the tax could be used to fund conservation and innovation strategies. Taxation might be a coercive policy, especially for certain individuals, but the ethical case for coercive policies is very strong when the good to be preserved is important enough and when they force individuals to do something they have a moral obligation to do anyway. I argue that, in the case of mild and self‐limiting infections, individuals have a moral duty of easy rescue and a moral duty of fairness to make their contribution to the preservation of the common good of antibiotic effectiveness by foregoing antibiotics. I also suggest that taxing antibiotics in such cases is an all things considered ethically justified policy even if it would introduce inequalities in access to healthcare. (shrink)

The range of opportunities people enjoy in life largely depends on social, biological, and genetic factors for which individuals are not responsible. Philosophical debates about equality of opportunities have focussed mainly on addressing social determinants of inequalities. However, the introduction of human bioenhancement should make us reconsider what our commitment to equality entails. We propose a way of improving morally relevant equality that is centred on what we consider a fair distribution of bioenhancements. In the first part, we identify three (...) main positions in the debate on bioenhancement and equality, and we show how each of them fails to meet the demands of a serious commitment to equality. In the second part, we formulate a new proposal that we think better promotes equality of opportunities: people from disadvantaged socio-economic backgrounds should be given access to bioenhancements while people from privileged socio-economic background should be prohibited from using them. We argue that those who are concerned about the inequality implications of bioenhancement should embrace this solution, rather than reject bioenhancement. (shrink)

Positional notation and related numerical manipulation techniques of Indian origin were introduced to Europe during the twelfth century through Arabic mediation and vividly described by Fibonacci as modus Indorum, the method of the Indians. This article aims to juxtapose Sanskrit and Latin texts to highlight the connections and differences between matrix and reflection in a complex cultural process of diffusion and assimilation. With reference to positional notation, this contribution examines a conceptual distinction between the graphical notion of position and a (...) logical-classificatory principle hitherto perhaps not fully recognized, although present in the texts of both traditions. The thesis of a consequent diagrammatic conception of positional notation in its origins, as a system of rules relating graphical position and order of magnitude, is also advanced. (shrink)

In this paper, I will first of all claim that once one takes proper names as indexicals of a particular sort, indexinames for short, one may account for some tensions that affect our desiderata regarding the use of such names in sentences directly or indirectly involving fiction. According to my proposal, a proper name “N.N.” is an indexical whose character is roughly expressed by the description “the individual called ‘N.N.’ (in context)”, where this description means “the individual one’s interlocutor’s attention (...) is called to by means of ‘N.N.’ (in context)”. This character is a partial function that maps narrow contexts onto referents. Such contexts are enriched narrow contexts, for they also include an ‘acquisition’ parameter, i.e., a parameter filled by a naming practice constituted by a dubbing, which consists in calling via the name one’s interlocutor’s attention to something (if any), and usually also by a certain transmission chain. I will also claim that such a proposal works independently of one’s ontological stance on fictional entities, that is, independently of whether one believes either that there are or that there are no such entities. Moreover, I will claim that such a proposal is better than similar indexicalist proposals such as the one put forward by Tiedke (2011), Finally, I will try to show how this proposal can deal with some objections one may raise against an indexicalist treatment of proper names. In this paper I will first contend that semantically based arguments in favour of or against problematic entities—like those provided, respectively, in a realist Meinongian and in an antirealist Russellian camp—are ultimately inconclusive. Indeed, only genuinely ontological arguments, specifically addressed to prove (or to reject) the existence of entities of a definite kind, suit the purpose. Thus, I will sketch an argument intended to show that there really are entities of an apparently specific kind, i.e. _intentionalia_, broadly conceived as things (...) that may actually exist as well as actually not exist. Finally, I will try to explain why that argument proves the existence of only some sorts of _intentionalia_, by showing how this is related to the fact that, as some have correctly maintained, _intentionalia_ have no intrinsic nature. The term Ubuntu is often presented as a mere ontological, philosophical African worldview. However, the aim of this article is to equate Ubuntu philosophy with a category of open legal principles of a constitutional nature, which, although they are not formally enshrined in the written constitutions of southern African countries that share the Bantu culture, have a normative deontic character. Therefore, it is worth emphasising that this category of thought is socially present as a norm of practical reason, from which (...) emanates the concept of justice of the Bantu peoples, who preserve a communitarian cultural identity rather than individualistic Western liberalism. The purpose of this study is to associate this worldview with a constitutional foundation of African states, especially those in southern Africa, equating it with the principles of human dignity, equality and freedom, etc., which is important for the consolidation of human rights in Africa. On the other hand, this worldview is confronted by the post-modern paradigms of global liberalism, which is also currently amalgamated in African countries. In order to achieve this objective, the research will be conducted using a methodology based on a bibliographical review and a deductive approach, supported by elements of constitutional legal dogma. In this paper I want to claim, first, that despite close similarities, noneism and Crane’s psychological reductionism are different ontological doctrines. For unlike the latter, the former is ontologically committed to objects that are nonentities. Once one splits ontological from existential commitment, this claim, I guess, is rather uncontroversial. Second, however, I want to claim something more controversial; namely, that this ontological interpretation of noneism naturally makes noneism be nonstandardly read as a form of allism, to be however appropriately distinguished (...) from Quinean allism in terms of the different scope of the overall ontological domain on which the only particular/existential quantifier that there is ranges. This may orient a noneist towards a syncretistic view of existence, according to which, appearances notwithstanding, existence as a whole is captured both by means of second-order and by means of first-order related notions. Antes de incorporarse al Institut für Sozialforschung, encabezado por Horkheimer y Adorno, el joven Herbert Marcuse propuso la idea de una fenomenología dialéctica, un diálogo entre el pensamiento de Marx y de Heidegger, elaborado entre 1928 y 1933, en el marco de su habilitación docente. Pero, con su posterior adhesión al naciente programa de teoría crítica, tal propuesta fue abandonada y ensombrecida por la obra posterior de su autor. El presente artículo busca, en primer lugar, mostrar en qué consistía tal (...) fenomenología dialéctica (apropiación de Heidegger), con el objetivo de evaluar si ésta aún puede abonar al desarrollo de los estudios fenomenológicos. En segunda instancia, se indagan las razones filosóficas por las cuales dicho proyecto quedó suspendido (crítica de Heidegger). A partir de los resultados, se proponen algunas líneas de investigación que apuntan a la posibilidad de una reelaboración contemporánea de la fenomenología dialéctica. (shrink)

RESUMOAs muitas definições de tecnociência são oferecidas como corretivas para um ideal de ciência pura, completamente separada da sociedade. A crítica da pureza nos estudos de ciência e de tecnologia foi precedida por críticas fenomenológicas em Heidegger e em Marcuse. A ideia de pureza não é mais crível. No entanto, o conceito de ciência pura tem desempenhado historicamente um papel na defesa da ciência contra interferências políticas. O conceito de tecnociência corre o risco de abrir a ciência a essa interferência (...) e tem provocado uma defesa renovada e, de certa forma, fútil da sua pureza. O consenso nos Estudos de Ciência e Tecnologia (ECT) de que a ciência é fundamentalmente social parece tornar óbvia a necessidade de um termo como tecnociência. Este artigo sugere uma definição restritiva de tecnociência com base na multiplicação de testes independentes de validade. Esse é um caso extremo da sociabilidade da ciência, porque aqui a ciência e a tecnologia emergem juntas, em vez de a teoria preceder a aplicação. A tecnociência sob essa definição descreveria o trabalho científico, validado cientificamente, que serve simultaneamente em processos comerciais e públicos que têm sua própria lógica e seus testes de validade independentes. De acordo com essa definição, a existência de interações complexas entre ciência e sociedade não obscurece as fronteiras entre esses testes. A tecnociência está inserida na sociedade, como toda ciência, mas é única ao se situar em um “garfo” [ataque duplo no xadrez] entre linguagens e critérios de sucesso distintos. In his recent book on the philosophy of mind, Tim Crane has maintained that intentional objects are to be conceived as schematic entities, having no particular intrinsic nature. I take this metaphysical thesis as fundamentally correct. Yet in this paper I want to cast some doubts on whether this thesis prevents intentionalia, especially nonexistent ones, from belonging to the general inventory of what there is, as Crane seems to think. If my doubts are grounded, Crane’s treatment of intentionalia may further (...) be freed from a certain tension that seems to affect it, namely the fact that he appeals to nonexistent intentionalia in order to individuate intentional states and at the same time he attempts at dispensing with them. In the philosophy of fiction, a majority view is continuism, i.e., the thesis that ordinary names, or genuine singular terms in general, directly refer to ordinary real individuals in fiction-involving sentences – e.g. “Napoleon” in the sentences that constitute the text of Tolstoy’s War and Peace. But there is also a minority view, exceptionalism, which is the thesis that such terms change their semantic value in such sentences, either by directly referring to fictional surrogates of those individuals – what we (...) may call exceptional hyperrealism about fictional characters – or by acquiring a semantic value that turns them into nonreferential terms, involving no ontological commitment to such characters – exceptional irrealism about fictional characters. In this paper, first of all, I want to support hybrid exceptionalism, according to which both parties are partly right and partly wrong. In the fictional use of fiction-involving sentences, those terms directly refer to ordinary real individuals, as continuists claim, while both in the internal and the external metafictional use of fiction-involving sentences, such terms change their semantic value, as exceptionalists claim. (By contrast, for pure exceptionalists such terms either always refer to fictional surrogates or are nonreferring on all such uses.) Moreover, I will argue that hybrid exceptional hyperrealism must be preferred to hybrid exceptional irrealism: in the latter uses, I claim, such terms directly refer to fictional surrogates. (shrink)
